1. CONDITIONS FOR MAKING AN ORDER

1.1. Any person making an order via the Site on a private basis declares that they are 18 years of age and have the legal capacity or failing that parental authorisation allowing them to place the order. In the event that these conditions have not been fulfilled as set out in this present contract and in order to resolve any disputes, Adira reserves the right to deal directly with the tutor or legal guardian of the person in question. This specifically means that Adira will consequently be authorised to demand payment from the tutor or legal guardian for any orders that the person may have made.

1.2. Any person placing an order via the Site declares that they are 18 years of age and have the legal capacity or failing that authorisation from the company, organisation or any other related entity which may employ them, which allows them to enter into a purchase in its name. In the event that these conditions have not been fulfilled as set out in the clauses in this present contract and in order to resolve any disputes, Adira reserves the right to deal directly with the person which placed the order and to demand payment from them personally, insofar as the person will have guaranteed us in advance when they asked to open an account that they were entitled to enter into agreements on behalf of the company or entity which employed them.

2. APPLICATION OF THE TERMS AND CONDITIONS

In placing an order, the Customer states that he or she has read, understood and accepted unreservedly the present Terms and Conditions. Adira reserves the right to modify the present Terms and Conditions at any time by publishing a new version on this present site. Any order which is made after Adira has published the new version of its Terms and Conditions implies acceptance of the latter.

3. RESERVATION OF PROPERTY

3.1. Articles which have been delivered remain the property of Adira for as long as the Customer has not acquitted his or her obligations towards Adira, notably the payment of the total amount of the invoice corresponding to the order which he or she placed via the Site.

3.2. In the event of a delay in payment based on the indication of the deadlines clearly set out on the invoice attached to the articles ordered when they were delivered, of non-payment despite reminders and should no agreement have been found, Adira reserves the right to demand of the Customer that the articles in question be returned immediately with the Customer bearing the costs.

4. PRICING POLICY

The prices published on the Site are shown in Swiss francs (CHF) and euros (EUR) and include all applicable taxes for Switzerland but exclude postage and packing. The latter are calculated based on the country of delivery of the order (Switzerland, Europe or other) and are added to the amount of the articles ordered.

5. AVAILABILITY AND DELIVERY TIMES

Despite the various precautions which Adira takes, it can happen that one or more of the articles which was stated as available at the time the order was made turns out to be unavailable, and Adira will of course inform the Customer of this fact. In the event that the article is merely temporarily unavailable, Adira will consider that the order is still valid until Adira is able to fulfil it by sending the article. Should the article(s) which make up the order be permanently unavailable (out of stock, no longer produced etc.), Adira will be forced to cancel the order.

6. DELIVERY

Methods of delivery of the orders

Orders are sent out by “Economic mail”. Delivery times vary based on the country to which the order is being sent and also on the postal or other services involved over which Adira has no influence.
Postage and packing

Depending on the where the order is being sent, the Customer will have to pay for postage and packing on top of the cost of the articles being ordered.
Customs fees

Any customs fees and taxes which apply to specific countries for delivery outside of Switzerland are your responsibility and are to be paid by the Customer over and above the cost of the order and the postage and packing. Depending on the applicable laws in the country to which the order is being sent, these fees can be demanded of the recipient of the package, even if the Customer is the person who placed the order. It is therefore the Customer’s responsibility to get the necessary information from the relevant authorities in his or her country or that of the recipient of the order.

7. METHODS OF PAYMENT AND SECURITY

On the Site, the methods of payment available and the security system are those offered by the www.paypal.ch website.

8. RETURNS AND EXCHANGE POLICY

The Customer has the possibility, under certain conditions specifically stated in the present Terms and Conditions, to return the article which he or she has ordered or to ask for an exchange.
Returns policy

For deliveries made by the Swiss Postal Service, and those deliveries alone, of an article which does not correspond to the order or which was damaged during transport, the Customer has seven (calendar) days from the date of delivery, based on the post mark, to make a request and return the article in question.
So that Adira can record and process the Customer’s request as quickly as possible, the latter is requested to include a copy of the invoice or delivery coupon.
Any article which does not correspond to the order and which is the object of a refund or exchange request should be returned (which Adira covering the costs) in its original packaging, still sealed and neither used nor damaged, to the following address:

Should all of these conditions have been respected, Adira agrees to cover all costs and send the Customer a new article as soon as possible.

9. LEGAL INFORMATION

9.1. Access to the Site

The Customer is authorised to have access to and to use the Site purely for personal reasons and under no circumstances, except with specific written consent from Adira, may he or she use it or its entire content for commercial means or for any other activity which may harm the company, at the risk of incurring criminal charges.

9.2. Governing law

The various clauses which figure in the present Terms and Conditions as well as any sales and purchases which they cover are governed by Swiss law.

9.3. Liability

Adira states that it will do all that it can to ensure the best possible quality of service based on the work carried out by the entire personnel of the company. However, it cannot be held liable for any delays in delivery of articles which have been ordered and in particular in the event of delays in delivery of such articles by the Swiss Postal Service.

Despite due care and attention and the various precautions which Adira takes to enable customers to use these services, it cannot guarantee that there will be no interruption in the functioning of the Site and its various sections. Therefore:

Adira declines all responsibility for damages, either direct or indirect, which may result from access to or use of the Site or any of its sections, and all responsibility which may result from the inability to access or use the Site.

Adira furthermore declines all responsibility for any risks inherent in the installation of software enabling the Site to be consulted or for any damages resulting from errors in transmission, technical faults, overloads or breakdowns in communications.

Moreover, the Customer is solely responsible in the event of an order for an article which may not conform to the legislation of the country of delivery or which may be banned within that territory, and in this respect Adira can in no way be required to assume any of the responsibilities.

9.4. Protection of personal data

Whatever the nature of the personal data concerning the Customer which Adira is required to obtain, either when requesting them as part of an order or collecting them automatically, Adira hereby states that it will make every attempt to handle them with the strictest confidentiality, take the necessary means to protect them and only ever to use them to carry out the requirements of the Customer or to improve the services which may be offered on the Site.

The Customer may however at any time exercise his or her right to obtain, correct or oppose such data by means of his or her customer account or in writing via e-mail.
